We do split the legal work in to two; first stage is notification letter and mediation session (mandatort for the lawsuit) and as second stage is litigation.
A notification letter will be delivered to the Turkish Company. In this letter, we are either
- Provide additional reasonable time to the opposing party to deliver the goods or;
- We are going to declare avoidance of the contract and claim full refund and related losses
If the Turkish company ignores the notification then we move forward to the next step.In the Turkish legal system, in cases where both parties are merchants, it is mandatory to apply to mediation before filing a lawsuit. Before filing a lawsuit, the mediator will be consulted and the two parties and/or their attorneys will have a meeting with the mediator. The purpose of this meeting is to reduce the workload of the court. During this meeting, it is aimed for the parties to settle amicably. First stage quotation is determined as USD 1.500 for the legal work excluding VAT (%20) excluding notary fees which will be around USD 600.
In the event that the parties cannot agree at the mediation meeting, a report is issued regarding the negative outcome of the mediation. After this, a lawsuit for full refund and losses can be filed at the Commercial Court of First Instance.
When a lawsuit is filed, the CISG requires the defendant to pay the amount paid so far, interest calculated in dollars from the day of payment, and lost profits. The lawsuit consists of fees such as advance fee, power of attorney fee, expert fee, translation of evidence by sworn translator, transportation to court to attend the hearings etc… Advance fee is calculated as **0.69% of the claimed amount. **The initial claim is going to be only the amount that needs to be refunded, the losses are going to be later calculated by the expert. The expert fee depends on the case, in these cases it is usually delivered to a calculation expert to make an exact calculation of the losses.
The expert fee is usually around **350 USD. T**ranslation of the evidence depends on the length of the documentation and correspondence between parties. Our legal service fee is to initiate and follow up the case is USD 3.500 excluding VAT (%20)
