The litigation department is headed by Ann-Suhet Kamffer, an admitted attorney with a particular specialised skill set in litigation and debt collection. Our debt collection's department also shares the expertise of Damian Swabey, an admitted attorney with twenty-two years post articles experience. Damian has been a collections call centre manager and has previously managed thirteen of the foremost and biggest Debt Collections Agencies and Attorneys in South Africa, Namibia and Bostwana, while employed by BNP Paribas. This was done by managing the EDC's monthly and annual targets through various Key Performance Indicators (KPIs).
In order to fully understand the collections book at hand, we need to understand the different stages of delinquency rules and stages i.e. Early Stage, Late Stage and Post Write-off/Recoveries collections. This provides insight into what the credit provider needs and whether a Formal Proposal is required and for which stage of delinquency. It also determines the commercial arranges i.e
- Early Stage (0 to 90 days arrears) commission around 2-5%;
- Late Stage (91 t0 180/210 days arrears) commission between 10 and 15%; and
- Post Write Off/ Recoveries with commission of 20-30%.
Kindly note that all commissions are payable are only upon successful collection and thus takes place on a contingency basis. No other costs will be payable. This would include, no telephone call costs, no text messaging costs, no emails costs etc.
The above relates to pre-legal collections i.e. Not proceeding to litigation.
Our litigation collection proceedings costs and services will be governed by an agreed Service Level Agreement, on an Attorney-Client scale, which is generally billed at an hourly rate of R2 200.00 (VAT included).
