Pre-trial debt collection:
- sending a pre-trial claim with a deadline for repayment of the debt before going to court;
- appeal to the notary authorities (as necessary);
Judicial debt collection:
- Waiting for the expiration of the deadline for repayment of the debt specified in the pre-trial claim;
- Preparation of the claim;
- Payment of state duty – 3% of the amount owed;
- Filing a lawsuit in court;
- Consideration of the claim in the court of first instance within 2 (two) months, if there is an appeal, then another 2 (months) will be added;
- After the court Decision enters into legal force, the court decision is transferred for enforcement to a private or collection state organization, whose services are paid by the debtor. In the process of executing a court decision, the debtor is arrested on bank accounts and property until the debt is repaid, with the possibility of selling the debtor's property at auction in order to repay the debt.
