Our experience covers not only provision of advice in the negotiation phase of a contract, but also in respect of debt collection. We have experience in the following fields of law relating to debt recovery:
- payment order: in Hungary, issuance of a payment order is the simplest and easiest way of debt collection.
- Litigation: if payment order is not feasible, we have a waste experience in litigation before ordinary courts and also before Hungarian and international arbitration.
- Liquidation: We have experience in starting liquidation against debtors in case this proves to be the more suitable way to force the debtor to pay the outstanding invoice.
- Enforcement procedure: We have experience in enforcement on the basis of final court judgment, and also on the basis of Hungarian notarized documents, on the basis of which, it is easier to make and enforcement.
- Recognition of foreign court judgment: We have experience in recognizing a foreign court judgment in Hungary as enforceable.
- Adoption of unlimited liability of managing director: We have successful litigation experience in adopting unlimited liability of managing director of the debtor for the debt of the company which is a possibility in certain circumstances in Hungary.
Prior to any enforcement, we make a due diligence of the debtor in respect of its financial status (on the basis of publicly available information) as sometimes the debtor is already fantomized without any remaining assets to cover the debt. We believe that this is also a very important information in debt recovery cases.
We have written a detailed guide about debt collection. Click the button below to read it.
